Acting Labor and Employment Secretary Marianito D. Roque announced that April 7, Monday, has been declared a regular non-working holiday nationwide in observance of the Araw ng Kagitingan on April 9 according to Proclamation No. 1463.
Proclamation No. 1463, issued by President Gloria Macapagal-Arroyo, setting the specific dates of movable holidays as mandated by Republic Act No. 9492 which rationalized the celebration of the country’s holidays.
According to Roque, holiday pay rules, supposedly applicable for April 9, shall be applied instead on April 7.
Workers should be paid 100 percent of their regular salary for that day if it is the workers’ regular workday and the day is unworked.
If worked, 200 percent shall apply for the first eight hours, and an additional 30 percent of the hourly rate for the work in excess of eight hours.
If the day falls on an employee’s rest day and is unworked, 100 percent of the regular daily rate shall apply. If worked, the employee shall receive 230 percent of the regular daily rate for the first eight hours, and an additional 30 percent of the hourly rate for work in excess of eight hours.
